This website is operated by Andrew O'Leary (contact: hello@fertela.agency), who acts as data controller for the personal data described below. Full identification details are in the legal notice.
This site sets no cookies of its own and collects no analytics. We process personal data only when you contact us: (a) by email; (b) by booking a consultation through Google's appointment scheduler, which asks for your name, email address and clinic name; and (c) by requesting a Fertility Clinic Growth Plan through the form on this site.
The Growth Plan form asks for your name, role, clinic name, city, email address, clinic website and, optionally, a phone number, together with business information about your clinic (for example the treatments you offer, where your international patients come from, your consultation capacity, your marketing activity and budget range). We use this information to review your clinic, prepare your Growth Plan, contact you to arrange a call about it and follow up with you about your request.
If you tick the optional box on the form, we will also send you commercial information, newsletters and promotions from Fertela by email. You can unsubscribe at any time, using the link in any of these emails or by writing to hello@fertela.agency. If you don't tick the box, we won't send you these emails.
The booking scheduler is provided by Google. It loads inside this site, or in a new tab, only when you click a booking button. When it loads, Google may set its own cookies, as described in Google's cookie policy.
We use this data solely for these purposes. We do not collect patient or health data through this site, and we ask you not to include any patient information in the form.
We rely on taking steps at your request prior to a possible contract (Article 6(1)(b) GDPR), including preparing a Growth Plan you have requested, and on our legitimate interest in responding to business enquiries and following up with clinics about a Growth Plan they have requested (Article 6(1)(f) GDPR).
We send commercial information, newsletters and promotions by email only with your consent (Article 6(1)(a) GDPR and Article 21 of Spanish Law 34/2002, LSSI-CE). You can withdraw it at any time; this doesn't affect anything we sent before you withdrew it.
Email, scheduling and the handling of Growth Plan form submissions (Google Apps Script, Gmail and Google Sheets) are provided by Google Ireland Ltd under Google Workspace, acting as our processor. When you submit the form, your browser sends it directly to Google's servers. This site is hosted on GitHub Pages (GitHub, Inc.); as with any web host, GitHub may process visitor IP addresses in server logs for security and operational purposes. We do not have access to, and do not use, any visitor analytics.
Enquiry correspondence is kept for as long as needed to handle the enquiry and any resulting business relationship. After that, we keep only what other laws require us to keep, such as invoices for tax purposes, and only for as long as those laws require.
The personal details in a Growth Plan submission (your name, role, email address and phone number) are deleted 24 months after we receive it. We keep the information about your clinic.
You may request access, rectification, erasure or restriction of your personal data, request portability, or object to processing, by writing to hello@fertela.agency. You may also lodge a complaint with the Spanish supervisory authority (AEPD, www.aepd.es).
